Although I am not a lawyer and this is not legal advice (you know it has
to be said. . . . ) my general response to questions like this is along
these lines:
For some rightsholders (authors and publishers) the difference between
the two (e-reserves and distance education projects involving (C)
material) is minor- the salient questions are more like, Is it
passworded or IP domain-verified access? What does my material 'look
like' after you've scanned it? ... For other rightsholders, the
difference may matter more (and that difference may be manifested as a
different royalty).
Either way, the norm (and the safest rule of thumb) should be to seek
permission, either directly from the rightsholder or through us at CCC.
